These terms and conditions apply to the User who uses the

for any payment made to QDegrees Services Private Limited.
Kindly read these terms
and conditions carefully. By authorizing a payment to
QDegrees
Services Private
Limited through the online payment service, it would be
treated
as a deemed
acceptance to these terms and conditions. QDegrees Services
Private Limited reserves
all the rights to amend these terms and conditions at any
time
without giving prior
notice. It is the responsibility of the User to have read
the
terms and conditions
before using the Service.

The following is a summary of the key terms of this service:
- Payment(s) through this Service may only be made with a
Credit Card, Debit Card
or Net Banking.
- The Credit Card information supplied at the time of
using
the service is
processed by the payment gateway of the service provider
and
is not supplied to
QDegrees Services Private Limited. It is the sole
responsibility of the User of
the service to ensure that the information entered in
the
relevant fields are
correct. It is recommended that you take and retain a
copy
of the transaction
for record keeping purposes, which might assist in
resolution of any disputes
that may arise out or usage of the service.
- The Client/Customer agrees, understands and confirms
that
his/ her personal data
including without limitation details relating to
Debit/Credit Card/Net Banking
transmitted over the Internet may be susceptible to
misuse,
hacking, theft
and/or fraud and that QDegrees Services Private Limited
or
the Payment Service
Provider(s) have no control over such matters.
- The service is provided using a payment gateway service
provider through a
secure website. However, neither the payment gateway
service
provider nor the
QDegrees Services Private Limited gives any assurance,
that
the information so
provided online by a user is secured or may be read or
intercepted by a third
party. QDegrees Services Private Limited does not accept
or
assume any liability
in the event of such unauthorized interception, hacking
or
other unauthorized
access to information provided by a user of the service.
- The Client/Customer agrees that QDegrees Services
Private
Limited or any of its
employees will not be held liable By the Client/Customer
for
any loss or damages
arising from your use of, or upon the information
contained
on the Website, or
any failure to comply with these Terms and Conditions
where
such failure is due
to circumstance beyond QDegrees Services Private Limited
reasonable control.
Debit/Credit Card, Bank Account Details:
- 1. The Client/Customer agrees that the Debit/Credit Card
details provided by
him/her for use of the aforesaid Service(s) must be
correct
and accurate and
that the Client/Customer shall not use a Debit/Credit
Card,
that is not lawfully
owned by him/her or the use of which is not authorized
by
the lawful owner
thereof. The Client/Customer further agrees and
undertakes
to provide correct
and valid Debit/Credit Card details.
- 2. The Client/Customer may pay his/her amount/charges to
QDegrees Services
Private Limited by using a Debit/Credit Card or through
Online Banking account.
The Client/Customer warrants, agrees and confirms that
when
he/she initiates a
payment transaction and/or issues an online payment
instruction and provides
his/her card /bank details:
- 3. The Client/Customer is fully and lawfully entitled to
use
such Debit/Credit
Card, Bank Account for such transactions;
- 4. The Client/Customer is responsible to ensure that the
Card/Bank account
details provided by him/her are accurate;
- 5. The Client/Customer is responsible to ensure that
sufficient credit is
available on the nominated Card/Bank account at the time
of
making the payment
to permit the Payment of the dues payable or fees dues
selected by the
Client/Customer inclusive of the applicable charges.
No warranty:
No warranty, representation or guarantee, express or implied,
is
given by the
QDegrees Services Private Limited in respect of the
operation of
the service.
Disclaimer and Limitation of liability:
QDegrees Services Private Limited and/or the Payment Service
Providers shall not be
liable for any inaccuracy, error or delay in, or omission of
(a)
any data,
information or message, or (b) the transmission or delivery
of
any such data,
information or message; or (c) any loss or damage arising
from
or occasioned by any
such inaccuracy, error, delay or omission, non-performance
or
interruption in any
such data, information or message & consequential damage of
any
kind which may be
suffered or incurred by the User from the use of this
service.
Under no
circumstances shall the QDegrees Services Private Limited
and/or
the Payment Service
Providers, its employees, directors, and its third party
agents
involved in
processing, delivering or managing the Services, be liable
for
any direct, indirect,
incidental, special or consequential damages, or any damages
whatsoever, including
punitive or exemplary arising out of or in any way connected
with the provision of
or any inadequacy or deficiency in the provision of the
Services
or resulting from
unauthorized access or alteration of transmissions of data
or
arising from
suspension or termination of the Service. Governing law:
These terms and conditions are governed by the laws of India
and
the competent
courts at Jaipur, Rajasthan shall have exclusive
jurisdiction.
Refund/Cancellation Policy:
Amount once paid will not be refunded under any
circumstances.
Privacy Policy:
- In General Client/Customer may browse this website for
obtaining any data or
information. However, in order to access the classified
information, one needs
to use the credentials provided as a Client/Customer
user.
- The information provided by the user on this website
shall
be kept confidential
and shall not be shared with anyone. The DATA will
neither
be made accessible to
third parties nor transferred in any form or manner
unless
required by law from
a competent authority of Government.
- QDegrees Services Private Limited may share your
personal
information with our
bankers for clearing necessary paid payments. This
information shall be strictly
up to the legal permissible limit and not exceeding.
- Online Payment system purpose to provide flexibility
and
conform to its
continuing Client/Customer by offering option to pay
online
using various
payment methods.
- It is sole discretion of Client/Customer to choose to
make
their respective
payments. QDegrees Services Private Limited do not
recommend/ prefer/promote any
particular method.
- If payment is made by means of a card that you do not
personally own, the
permission of the card owner must always be obtained to
make
payments using the
card. In using the system you confirm that you have such
permission.
- Information related to payments using debit or credit
card
is not accessed or
stored by the QDegrees Services Private Limited.
- No Warranty: The information and materials contained in
this site including,
graphics, links or other items are provided as on “As
Is”
and “As Available”
basis by the QDegrees Services Private Limited which
organized and tries to
provide information accurately and expressly disclaims
liability for error or
omission in this information and materials. No warranty
of
any kind, implied,
express or statutory shall be given by the QDegrees
Services
Private Limited
shall not be limited to the warranty of fitness for a
particular purpose and
freedom from computer virus is given in conjunction with
the
information and
materials.
- Limitation of Liability: In no event, QDegrees Services
Private Limited will be
liable for any damage direct or indirect losses or
expenses
arising in
connection with site or use thereof inability to use by
any
person delay of
operation or transaction, computer virus etc.
Security:
All payment details which are entered through this payment
gateway are encrypted when
the Client/Customer, or third party making payment, enters
them.
The site is secure
and uses best practices for encryption to offer secure
communications by encrypting
all data to and from the site. QDegrees Services Private
Limited
shall not be liable
for any failure by the Client/Customer or third party making
payment of Fees to
properly protect data from being seen on their screen by
other
persons or otherwise
obtained by such other persons, during the Online Payment
process or in respect of
any omission to provide accurate information in the Course
of
the Online Payment
Process.
Variations to the Terms and Conditions: The QDegrees Services
Private Limited
reserves the right to vary these Terms and Conditions from
time
to time and the
current version will be that published on this website.
We reserve the right to decline the acceptance of an online
payment if your account
is in default for any reason. QDegrees Services Private
Limited
may also make
additions/deletions/alteration to the services offered, at
its
sole discretion. We
reserves the right to withdraw the service at any time at
its
discretion. We retain
the right to change the terms and conditions for Online
Installation, renewal & any
other Payments, without any prior notice.
Entire Agreement:
These above Terms of Service constitute the entire agreement
between the parties with
respect to the subject i.e. “Online payment convenience
facility
through third
party/payment gateway” hereof and supersedes and replaces
all
prior or
contemporaneous understandings or agreements, written or
oral,
regarding such
subject matter.
Nondisclosure Agreement:
This Nondisclosure Agreement (this “Agreement”) is entered
into
by QDegrees Services
Pvt. Ltd. (hereinafter referred to as “Company”) for the
benefit
of Client/Customer
and its Affiliates. In connection with Company’s provision
of
partnering with
QDegrees for doing online surveys, Company may receive
information on
Clinet/Customer operations and businesses. In consideration
of
the receipt of such
information, the Company agrees as follows:
Confidential Information
1. “Affiliate” means any entity in which Client/Customer or
its
group companies have
directly or indirectly, certain economic interest, and
“Confidential Information”
means all nonpublic information relating to operations and
businesses disclosed by
Client/Customers or its affiliates to the company or
company’s
affiliates and such
other information that is designated as confidential or
that,
given the nature of
the information or the circumstances surrounding its
disclosure,
reasonably should
be considered as confidential.
Exclusions
2. Confidential Information excludes information that (i) is
or
becomes publicly
available without breach of this Agreement, (iii) is
disclosed
to Company from any
third party who did not acquire or disclose such information
by
a wrongful or
tortious act, or (iv) can be shown by documentation to have
been
independently
developed by Company without reference to any Confidential
Information.
Use of Confidential Information
3. Company may use Confidential Information only in pursuance
of
its business
relationship with Client/Customers. Except as provided in
this
Agreement, Company
will not disclose Confidential Information to anyone without
Client/Customers’s
prior written consent. Company will take all responsbility
to
avoid disclosure,
dissemination or unauthorized use of Confidential
Information,
including, at a
minimum, those measures it takes to protect its own
confidential
information of a
similar nature
Company Personnel
4. Company will restrict the possession, knowledge and use of
Confidential
Information to its employees and subcontractors who (i) need
to
know the
Confidential Information, and (ii) shall ensure that they
are
legally obligated to
protect the Confidential Information to the same or greater
degree as required under
this Agreement.
Disclosures to Governmental Authorities
5. Company may disclose Confidential Information as directed
to
comply with orders of
judicial and/or governmental authorities. Before such
disclosure, the Company will
(i) give 15 days prior written notice to Client/Customers
providing sufficient time
to allow Client/Customers to seek a protective order or
other
remedy (except to the
extent that Company’s compliance would cause it to violate
an
order of the judicial
and/or governmental authority or other legal requirement),
(ii)
disclose only such
information as is required by the judicial and/or
governmental
authorities, and
(iii) use commercially reasonable efforts to obtain
confidential
treatment for any
Confidential Information so disclosed
Ownership of Confidential Information
6. All Confidential Information will remain the exclusive
property of
Client/Customers. Disclosure of Confidential Information
with or
without the written
consent will not constitute an express or implied grant to
Company of any rights to
or under patents, copyrights, trade secrets, trademarks or
other
intellectual
property rights. Company will not use any trade name,
trademark,
logo or any other
proprietary rights of Client/Customers (or any of its
Affiliates) in any manner
without prior written authorization of such use by an
authorized
representative of
Client/Customers (or its applicable Affiliate).
Notice of Unauthorized Use
7. Company will notify Client/Customers immediately upon
discovery of any
unauthorized use or disclosure of Confidential Information
or
any other breach of
this Agreement. Company will cooperate with Client/Customers
in
every reasonable way
to help regain possession of such Confidential Information
and
prevent its further
unauthorized use and disclosure.
Return of Confidential Information
8. Company will return or destroy all tangible materials
embodying Confidential
Information (in any form and including, without limitation,
all
summaries, copies
and excerpts of Confidential Information) promptly following
written request.
Injunctive Relief
9. Company acknowledges that a breach of its obligations
under
this Agreement could
cause irreparable harm to Client/Customers as to which
monetary
damages would be
taken care by company. Company agrees that Client/Customers
will
have the right, in
addition to its other rights and remedies, to seek
injunctive
relief for any
violation of this Agreement.
Scope; Termination
10. This Agreement covers Confidential Information received
by
Company prior and
subsequent to the date hereof. This Agreement is effective
as of
the date
Confidential Information is first received and will continue
for
1 years, after
which it automatically renews unless either party terminates
this Agreement by
providing at least 90 days prior written notice to the other
party, provided, that
Company’s obligations with respect to Confidential
Information
will survive for
perpetuity following termination of this Agreement.
Miscellaneous.
11. This Agreement constitutes the entire non-disclosure
agreement between the parties
relating to the matters discussed herein and may be amended,
modified, or waived
only with the mutual written consent of the parties. Company
may
not assign this
Agreement without Client/Customers;s written consent. If a
provision of this
Agreement is held invalid under applicable law, such
invalidity
will not affect any
other provision of this Agreement that can be given effect.
This
Agreement will be
governed by the laws of India, without reference to its
conflict
of law rules. The
courts at Jaipur, Rajasthan will have exclusive jurisdiction
in
relation to any
disputes arising out of or relating to this Agreement. All
notices hereunder will be
in writing and will be sent by overnight courier, confirmed
facsimile transmission
certified mail. Notices to Company will be delivered to the
address set forth.
